Please read this End User License Agreement (the "Agreement") carefully. By downloading, installing, or using the "Birthday Candle" mobile application (the "App"), you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not download, install, or use the App.
The Developer grants you a limited, non-exclusive, non-transferable, and non-sublicensable license to install and use the App on a single mobile device that you own or control, solely for your personal, non-commercial use. The App is licensed, not sold, to you. You may not:
Modify, reverse engineer, decompile, disassemble, or attempt to derive the source code of the App;
Rent, lease, lend, sell, sublicense, or otherwise transfer the App;
Remove or alter any copyright, trademark, or other proprietary notices in the App;
Use the App for any unlawful purpose or in any way that infringes the rights of third parties.
All intellectual property rights in the App and its content (including but not limited to text, images, audio, video, code, and design) are owned by the Developer or its licensors. Except for the rights expressly granted in this Agreement, you acquire no other rights in the App.
Certain images, icons, graphics, and visual elements used in this App were created or derived from materials provided by Canva[](https://www.canva.com). Such content is subject to Canva's Terms of Use and Content License Agreement. In accordance with Canva's licensing policy, the App has been granted the necessary rights to use these materials for commercial purposes and to distribute them as part of the App. Canva retains all ownership rights in its materials and design elements.
The fonts used in this App are sourced from Google Fonts[](https://fonts.google.com). All Google Fonts are licensed under open-source licenses (primarily the SIL Open Font License 1.1 or Apache License 2.0), which permit commercial use, modification, and redistribution. The specific license terms for each font can be found on the Google Fonts website or in the LICENSE.txt file included with the respective font files within the App.
The App makes no representations or warranties regarding the availability, accuracy, or non-infringement of the foregoing third-party content, and disclaims all liability in connection therewith. You acknowledge that certain third-party content included in the App is licensed from Canva and Google Fonts under their respective terms. The Developer has complied with all applicable licensing requirements for such content as of the date of distribution. However, the Developer provides no warranty that such third-party content will remain licensed or available in the future, and shall not be liable for any claims arising from changes to third-party licensing terms or removal of content.
The App provides a virtual birthday candle simulation that uses the device's microphone to detect blowing sounds to "extinguish" the candle, and allows users to upload personal photos as celebration backgrounds. The App displays advertisements (including rewarded ads) and offers in-app purchases (including subscriptions to unlock unlimited photos and remove ads).
To provide these features, the App may request the following permissions:
Microphone: To detect blowing sounds and trigger the candle-extinguishing effect.
Photos/Media/Files Access: To select and display user-uploaded personal photos (limited to 3 for free users; unlimited for subscribers).
Storage: For temporary storage of app data (Android-specific).
Network Connection: To load ads, process in-app purchases, and verify offline usage.
These permissions are used solely for the stated features. You may revoke permissions at any time in your device settings, though this may impair certain App functions. The App does not record or transmit audio or photos without consent.
The App uses Google AdMob to display advertisements, including rewarded ads (watching an ad grants 24 hours of ad-free experience and offline usage). You agree to receive these advertisements. The Developer is not responsible for the content of advertisements.
The App offers in-app purchases, including a monthly subscription to unlock unlimited photos and other benefits. Purchases are governed by the terms of the Apple App Store or Google Play Store. You agree that:
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period;
Purchases are non-refundable (except where required by law);
A "Restore Purchase" feature is available for the same account across devices.
Your personal data is handled in accordance with the App's Privacy Policy, available via the in-app "Privacy Policy" link. The App may collect anonymized usage data to improve the experience and share advertising-related data via AdMob.
The App is provided "as is" without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The Developer does not warrant that the App will be error-free, uninterrupted, or meet your specific requirements.
To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the App. The Developer's total liability shall not exceed the amount you paid for the App (if any).
If you breach this Agreement, the Developer may terminate your license at any time. You may terminate this Agreement by deleting the App. Upon termination, you must cease all use and delete the App.
The Developer may update this Agreement at any time. Continued use of the App constitutes acceptance of the updated terms. Significant changes will be notified within the App.
Apple (for iOS users) and Google (for Android users) are third-party beneficiaries of this Agreement but have no obligation to provide maintenance or support.
This Agreement shall be governed by the laws of Hong Kong, without regard to conflict of law principles. Any disputes shall be submitted to the jurisdiction of the Taipei District Court.
